Section 41
Provisions relating to open prisons

(1) The prison administrator may recommend that the prisoner who can be kept in an open prison according to the prevailing law be kept in such a prison.
(2) Prisoners in open prisons may be engaged in the following work:-
(a) To work in a development project or program under the Government of Nepal or the State Government or in any public body,
(b) to act as a volunteer, or
(c) To undergo training related to capacity and skill development.
(3) In accordance with clause (a) of sub-section (2), the inmates assigned to work shall be provided with wages as prescribed, not less than the minimum wages prescribed by the Government of Nepal on the basis of contribution. However, the inmates who work part-time should be provided with wages as specified on the basis of contribution.
(4) Details of prisoners in open prisons shall be kept in the format prescribed by the prison administrator.
